These Terms and Conditions of Use expressly incorporate by reference and include the Urban Outfitters Inc. PRIVACY POLICY and any other guidelines, rules or disclaimers that may be posted or updated on specific web pages herein or on any notice sent to you.

These Terms and Conditions of Use govern the collaborative Urban & Lomo photographic competition (the "Challenge") on lomography.com (“the "Site"). By submitting a work to the Challenge you agree to the following Terms and Conditions of Use. If you do not agree to these Terms and Conditions of Use, please do not participate in this Challenge. The Parties reserve the right, at our sole discretion, to change, modify, add, or remove portions of this policy at any time.
We encourage you to review these Terms and Conditions of Use from time to time, because any changes are binding on you.
- Participation is open to all ages.
- In the event that a Participant under the age of 21 wins the Grand Prize (Trip to the Lomography World Congress in London), they must be accompanied by a parent or guardian. This parent or guardian is responsible to pay for their own airfare, accommodation, and ticket for the World Congress activities.
- Your submission to the Challenge (the Submission) may be used and reproduced by the Parties without expiration. The main image use will be in connection with the Challenge on the Site but is not limited hereto but also within any or all Urban retail stores, websites and communication efforts in any country, and in any press, promotional, exhibiting and publishing effort related to the Challenge and to Lomographische AG’s activities internationally without expiration. If you do not agree to these Terms and Conditions of Use, please do not participate in this Challenge.
- The Copyright for your submissions remains in your possession. You are free to use your image submissions for any desired personal or commercial purpose outside of the Challenge and without permission from the Parties.
- All rights, title and interest in and to all aspects of this Site remain the property of the Parties. You may access the Site for your personal, non-commercial use only. You may not reproduce, copy or post a Submission from another Participant other than yourself anywhere on the Internet or elsewhere. Copying, storing or reproducing of any content is expressly prohibited without the prior written permission from the Parties and the copyright holder identified in the individual content's proprietary notices including copyright notice.
- When submitting individual images created by more than one person (example, a multiple exposure image shot by two or more photographers), the Participant acknowledges the copyright permission of all persons involved in the image's creation. The Parties are not obligated to award more than one prize per image. In the event of a copyright dispute among Participants, the Parties reserve the right to render prize awards null and void. In summary, do not submit images which you do not hold 100% copyright to unless the other creators have given their express permission for you to assume full ownership.
- You hereby agree and acknowledge that neither title nor intellectual property rights to this Site are transferred to you by use of or access to this Site nor by participating in the Challenge; rather, all rights, title and interest in and to all aspects of this Site remain the property of the Parties. You may access the sites for your personal, non commercial use only. Copying or storing of any content for other than personal, non-commercial use is expressly prohibited without the prior written permission from the Parties or the copyright holder identified in the individual content's proprietary notices including copyright notice.
You hereby agree and acknowledge that you may not display, reproduce, exhibit or in any other way use the Submission, submitted to the challenge, in connection with any commercial or promotional activities of whatever kind. Neither title nor intellectual property rights are transferred to you by use of or access to this Site nor by participating in the Challenge; rather, all rights, title and interest in and to all aspects of this Site remain the property of the Parties. You may access the sites for your personal, non commercial use only, but may not reproduce or post a Submission anywhere on the Internet or elsewhere. Copying or storing of any content for other than personal, non-commercial use is expressly prohibited without the prior written permission from the Parties or the copyright holder identified in the individual content's proprietary notices including copyright notice.

Any use of Lomo´s intellectual property rights will be seen as an infringement of Lomo´s rights. You agree not to submit any infringing, unlawful, threatening, libelous, defamatory, obscene, pornographic or profane material or material that could constitute or encourage criminal or unlawful conduct, or material containing spam or advertising content. You acknowledge that you and not the Parties are solely responsible for the contents of your Submission, including its legality, reliability, and originality. The Parties are not obligated to monitor the contents of the Challenge; however, by submitting content which may, at the Parties sole discretion, be used in connection with this Challenge, you agree that the Parties have the right, in its sole discretion, to remove and delete postings for any reason whatsoever or for no reason at all. The Parties reserve the right to filter or block all posts and submissions from individuals who display persistent behaviour contrary to the Terms and Conditions of Use governing this Challenge.
COMPLIANCE WITH DIGITAL MILLENNIUM COPYRIGHT ACT. It is our policy to promptly respond to claims of copyright infringement. If you believe that an infringing copyrighted work has been posted on the Challenge section, you may notify our registered copyright agent by sending the following information to the address listed below:
- The signature of a person authorized to act on behalf of the owner of the copyright. This signature can be physical or electronic.
- A statement that this person is authorized to act on behalf of the copyright owner.
- A statement that this person has a good faith belief that the use of the material in the complained-of manner is not authorized either by the copyright owner, by the owner's agent, or by law;
- A description of the copyrighted work that you claim has been infringed, and a description of where the allegedly infringing material is located on the Site; and
- This person’s address, telephone number, and e-mail address.

We will process and investigate all notices of alleged infringement as required by the DMCA, and may, at the Parties sole discretion, remove or disable access to any material claimed to be infringing or claimed to be the subject of infringing activity. When we remove or disable access to any material claimed to be infringing, we may attempt to contact the user who has posted such material in order to give that user an opportunity to respond to the notification. If the user posting the material gives a counter-notification claiming that the use is authorized, we will furnish that counter-notification to the complaining party, and will give the complaining party an opportunity to seek judicial relief under the DMCA before we replace or restore access to any material.
UNDER NO CIRCUMSTANCES SHALL THE PARTIES OR ITS AFFILIATES, SUBSIDIARIES, PARENT OR RELATED COMPANIES BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT OR PUNITIVE DAMAGES), HARM, OR INJURY THAT RELATE TO, ARISE OUT OF, OR RESULT FROM THE USE OF, OR ACCESS TO, OR THE INABILITY TO USE, ANY OF THE MATERIALS OF THIS SITE, OR ARE CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATIONAL TRANSMISSION, COMPUTER VIRUS OR LINE FAILURE. THE MATERIAL ON THIS SITE COULD INCLUDE TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS. THE MATERIALS ON THIS SITE ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THE PARTIES DO NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THIS SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT THE CONTENTS WILL BE CORRECT, ACCURATE OR RELIABLE, OR THAT THIS SITE OR THE SERVERS THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU (AND NOT THE PARTIES) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.
If you allow us to post your name on the Site, we will not sell, rent, trade or otherwise disclose the personal information you provide to anyone outside of the Parties, except as noted below. The Parties may share your Information with the following entities:
- The Parties affiliated companies;
- The Parties and their affiliated companies' advertising and promotional agencies and consultants;
- Unaffiliated service providers with whom the Parties may subcontract, including web site hosting companies, fulfillment companies, and other third party service providers;
- Government agencies and law enforcement officials, when required to do so to respond to subpoenas, court orders or legal process, or to establish or exercise legal rights or defend against legal claims.
The Parties also reserve the right to share Information with other organizations in the following situations:
- As permitted by law in order to investigate, prevent or take action regarding illegal activities, suspected fraud, violation of the Parties respective intellectual property rights, situations involving potential threats to the physical safety of any person, violations of the Site's Terms and Conditions of Use or other agreements, or otherwise as required by law;
- When we have your consent to do so; and
- When we need to share Information to provide any product or service you have requested.
- The Parties also reserves the right to transfer your information to the purchaser of the Parties or substantially all of its assets in the event the Parties are sold.
We employ standard technical security measures to aid in protecting from outside threats any personal information you send to the Parties via the Site. However, electronic communications may not be secure, and there is a risk that information you send to us may be accessed by unauthorized third parties when communicated between you and the Parties electronically. The Parties does not represent, warrant or guarantee that information you send to us will be protected against unauthorized access, loss, misuse or alteration, and the Parties cannot take any responsibility for unauthorized interception, collection or disclosure of such information by third parties. This agreement shall be governed in accordance with the laws of the United States, notwithstanding any principles of conflicts of laws.
The Site is protected by copyright as a collective work and/or compilation, pursuant to U.S. copyright laws, international conventions and other copyright laws. Except as set forth in these Terms and Conditions of Use, you may not modify, adapt, translate, exhibit, publish, transmit, participate in the transfer or sale of, reproduce (except as provided in this section of the Terms and Conditions of Use), create derivative works from, distribute, perform, display, reverse engineer, decompile or disassemble, or in any way exploit, any of the content, software, materials or Site in whole or in part.
